Cody Michael Mittig, 22, of Allendale has been charged with two counts of first degree felony criminal sexual conduct for the alleged rape and sodomy of a woman; one count of first degree felony criminal sexual conduct while committing another felony; and, Mittig is also being charged with a five-year felony for allegedly stealing the woman’s vehicle.
He was arraigned on Tuesday Sept. 25 in Charlevoix 90th District Court. Bond was set at $20,000.
According to the affidavit of probable cause provided by the Charlevoix County Prosecutor’s office, the alleged female victim was found along M-66 near Washington Street at approximately 1:28 a.m. on July 25.
“(Victim) reported that she drove her (vehicle) to 7-Eleven to buy cigarettes; that a young white male asked for a ride to Ironton; (victim) agreed to drive him to Ironton,” the affidavit states. “(Victim) stated that when she got to Ironton the male came across the truck cab and bit (victim’s) right shoulder. (Victim) stated that they were wrestling and fighting until the male was able to pin her down and remove her clothes.”
The affidavit goes on to describe a graphic account of Mittig’s alleged rape and sodomy of the female victim while allegedly biting her further.
“The male then pulled (victim) out of her (vehicle) and she landed on her back. (Victim) was still lying on her back and he (raped and verbally assaulted her) again,” the affidavit states. “The male then got into (victim’s vehicle) naked and took off with her (vehicle) and dog.”
According to police documents, a K-9 unit was used to track the suspect and evidence was collected from the scene.
While investigating the scene, the officer was approached by a man who said his car had been recently stolen. The officer went to the nearby location and was able to identify bare footprints. The vehicle was later found on Jefferson Street/Wildwood Harbor Road in Boyne City.
Police then reviewed 7-Eleven surveillance tapes and saw the alleged victim speaking with the suspect in question.
The alleged victim was taken to Charlevoix Area Hospital for criminal sexual conduct assessment. It was discovered that she had at least three bite marks on her shoulders and back.
According to police documents the suspect’s mobile phone, his clothing and clothing of the alleged victim were all found at the scene of the alleged crime.
Investigators met with Mittig where he allegedly admitted to having gone to a beer tent in Charlevoix on July 24.
“The next thing Mittig remembered was sitting in a lady’s (vehicle) naked and believing he just had sex with her,” the affidavit stated. “Mittig stated that he was naked and only had his wallet. Mittig went into survival mode and got the female out of the (vehicle) and had sex with her again before getting in her truck, naked, and leaving her there in Ironton.”
Mittig then allegedly told police he thought he went to another woman’s house where he got into his car but realized it was not his car.
“Mittig stated that he drove the car because his instincts were telling him that he needed to survive so he drove the car to his home,” the affidavit states. “Mittig admitted to going to breakfast … the morning of July 25, and using the $7 he found in the female’s purse.”
If found guilty, Mittig could face up to life in prison.
